FINANCIAL DISCLOSURE

 

APPLICABILITY TO PURCHASING AGENTS FOR JUVENILE WELFARE BOARD

SUMMARY:

 

The Executive Director and the Administrative Officer of the Juvenile Welfare Board of Pinellas County, a special tax district, share purchasing power for the district and therefore are public officers pursuant to s. 112.312(7)(j), F. S. (1974 Supp.). As public officers, both are subject to the financial disclosure provisions of part III, Ch. 112, F. S. (1974 Supp.).

 

QUESTION:

 

Do the financial disclosure provisions of s. 112.3145, F. S. (1974 Supp.), apply to me as the Executive Director and to Mr. William Markman as the Administrative Officer of the Juvenile Welfare Board of Pinellas County?

 

Your question is answered in the affirmative.

 

As Executive Director and Administrative Officer, you and Mr. Markman, respectively, share responsibility in purchasing office supplies and equipment for the Juvenile Welfare Board, a special taxing district within Pinellas County. Specifically included within the definition of the term "public officer" are "[p]urchasing agents for any agency or persons having the power normally conferred to purchasing agents by whatever title." Section 112.312(7)(j), F. S. (1974 Supp.).

You and Mr. Markman are purchasing agents within the scope of this section in that you share purchasing power for a special tax district which falls within the meaning of the term "agency" as found in s. 112.312(1), supra. It follows that, as public officers, you and Mr. Markman are subject to the disclosure requirements of s. 112.3145, supra.
